Technically the building has to conform to the code when it was constructed. If any improvements requiring a building permit are made then these improvements trigger either the 20% rule or full compliance.
The trigger is the cost of the permitted work, $139,934.00. Anything below this amount will require the owner to spend an additional 20% on ADA upgrades. Anything over this amount and requires complete compliance.
